AGB

1. scope

The General Terms and Conditions (hereinafter referred to as “GTC”) shall apply to all orders placed and contracts concluded (hereinafter referred to as “Order”) via the online store Isler Tools Onlineshop (hereinafter referred to as Isler Tools).

Isler Tools reserves the right to change the GTC. The version of the GTC valid at the time of the order shall apply in each case, which cannot be changed unilaterally for this order.

2. offer

The offer is directed to natural customers with residence or domicile in the legal clientele domiciled in Switzerland. Deliveries are made only to addresses in Switzerland.

The offer is valid while it is visible in the online store and/or while stocks last. Price and assortment changes are possible at any time. The images shown in the online store and all information about the products are for illustrative purposes and are not binding.

3rd price

The prices are in Swiss Francs, incl. Value Added Tax (VAT). The price in the online store at the time of the order is decisive.

4. order

The presentation of the products in the online store is not a legally binding application, but a non-binding online catalog or a non-binding invitation to the clientele to order the product in the online store.

An order shall be deemed to be an offer to Isler Tools to conclude a contract.

After submitting the order, the customer automatically receives a confirmation of receipt documenting that the order has been received by Isler Tools.

Isler Tools is free to refuse orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded, in particular there will be no forwarding of the products that cannot be delivered. Temporarily unavailable products cannot be preselected.

5. payment variants

Payments must be made in Swiss francs.

The available means of payment are displayed in the online store.

The debit will be made immediately.

Purchase on account is not possible.

6. conclusion of contract

A contract shall only be concluded upon processing of the order in the logistics center of Isler Tools. Once the order is ready for shipment, the clientele receives an order confirmation by e-mail.

7. delivery

The customer’s delivery address must be in Switzerland.

No deliveries are made on weekends and official national or cantonal holidays.

If the clientele is not on site at the time of delivery and has not given special delivery instructions, the delivery driver will leave a pickup invitation in the mailbox. The customer must then collect the delivery from the relevant post office.
Any order that is not picked up within the stated deadlines cannot be kept or refunded. The customer is solely responsible for orders that are picked up late and any rights for defects are excluded for this.

The clientele is requested to confirm their collection additionally by their signature. Any liability for damages incurred by the customer due to loss, theft, misuse, etc. in connection with the collection process or the collection ticket is expressly excluded.

The customer assumes responsibility for the delivered products, even if they were not directly received by him.

8. delivery costs

Delivery costs depend on the quantity of ordered products. The delivery costs communicated in the online store apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.

9. warranty

Isler Tools may provide warranty either by partial or complete replacement with an equivalent product.

10. returns

The buyer bears the cost of returns. Returns must be arranged in advance with Isler Tools(info@islertools.ch).

11. notice of defects

If products are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the delivery messenger and refuse acceptance, without prejudice to his rights in respect of defects. The customer is obligated to obtain a damage confirmation message from the delivery carrier. All transport damage must additionally be reported immediately to Isler Tools.

Furthermore, it is the customer’s responsibility to inspect the ordered products immediately upon receipt. For any defects or deviations from the order, Isler Tools customer service must be notified by e-mail info@islertools.ch on the day of delivery. Isler Tools reserves the right to demand proof of the defect.

12. transfer of risk

The risk shall pass to the Buyer as soon as the consignment has been handed over to the person carrying out the transport. If shipment is delayed or becomes impossible through no fault of ours, the risk shall pass to the Buyer upon notification of readiness for shipment. Any assumption of transport costs by von Isler Tools agreed in individual cases shall not affect the transfer of risk.

13. limitation of liability

Claims for damages arising from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort are excluded both against us and against our vicarious agents or assistants, except in the case of intentional or grossly negligent conduct. Any liability for consequential damages resulting from the use of the products is rejected.

14 Applicable court and place of jurisdiction

Bülach is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
